Vivint Notice of Insurance Information Practices

 

Vivint companies* licensed as insurance companies (“we,” “us” or “our”) provide insurance-related products for personal, family, and household purposes. This notice applies to information we collect about you and your dependents, beneficiaries, and other individuals that you provide information about in connection with our insurance offerings.

Vivint companies licensed as insurance companies include VI Holdings, LLC and its affiliates and subsidiaries, like Vivint Warranty and Home Insurance, LLC (d/b/a Vivint Insurance Agency).

This notice does not apply to information we collect about you in other contexts. Please review our general Privacy Notice (at https://www.vivint.com/legal/privacy-policy) for more information about our privacy practices generally.

Our Collection of Your Information

We may collect information from or about you when you interact with our insurance agents and representatives. For example:

Information you provide to us directly. We collect information directly from you, such as when you apply for a policy or a submit a claim. This information may include your name, email address, physical address, the address of the insured property, information and records about the insured property, claims history, employment history, hobbies, other insurance coverage, gender, marital status, military status, and similar information about your family members and dependents.

Information from your transactions with us. We collect information when you pay premiums, when we process claims, and through other transactions you may have with us. Information we collect through your transactions includes your payment card information, bank account information, and other financial account information.

Information obtained from our other products and services. We collect information when you use our products and services, such as our home security systems, security cameras, smart home devices, and subscription services. The information we collect includes, but is not limited to, video and audio recorded by your security cameras and other products. We also collect technical information about your products, such as information that relates to your use of the products (such as how many times you turn on your security system) and other information reported through sensors on the devices (such as how many times your alarm goes off).

Information from consumer reporting agencies. We obtain information about you from consumer reporting agencies, such as information on your credit history, claims history, payment history, a credit-based insurance score report, and related information. Information that we obtain from consumer reports may be retained by the consumer reporting agency and disclosed to other persons.

Information from our affiliates. We may receive information about you from our affiliates, including information about your purchases, payment history, inquiries and requests, and use of devices, products, and services.

Information from other third parties. We may collect information from other sources, such as members of your household, public sources, and insurance support organizations and other insurance companies. The information we gather may include information about your claims history and information about your property.

How We Use Your Information

We may use all of the types of information described above for purposes permitted or required by law, including the following purposes:

To provide and personalize our products and services, such as receiving and processing an application from you, determining your eligibility for an insurance product, producing a quote for you, creating and maintaining an account for you, and processing your claims (including determining whether a claim is legitimate or fraudulent). We also combine your information with information about your smart home products to coordinate the functions of your Vivint smart home system with your insurance products.

Communicating with you, including through our service providers, such as responding to your questions, comments, and requests, notifying you of updates to our products or services, and advertising products or services to you.

For internal business purposes, such as evaluating our risk of loss, assessing your interests, preferences, and satisfaction with our products and services, improving the quality of our products and services, including through data collected via your smart home system, and creating new products and services.

For legal, security, or safety reasons, such as protecting our and third parties’ safety, property, or rights, complying with legal requirements, enforcing our terms, conditions, and policies, detecting, preventing, and respond to security incidents, and protecting against malicious, deceptive, fraudulent, or illegal activity.

As part of a corporate transaction, such as in connection with the sale of part or all of our assets or business, the acquisition of part or all of another business or another business’ assets, or another corporate transaction, including bankruptcy.

How We Disclose Your Information

We may disclose your information as permitted or required by law, including without your prior authorization. This includes disclosures made to both affiliated and non-affiliated parties. The disclosures we make include the following:

To nonaffiliated third parties to help complete insurance transactions, such as payment vendors, consumer reporting agencies, other insurance companies, and insurance support organizations. We make these disclosures to detect or prevent fraud or other criminal activity, determine eligibility for an insurance benefit or payment, and otherwise to facilitate or complete insurance transactions.

To nonaffiliated third parties to perform a business, professional, or insurance function on our behalf, such as research organizations, marketing agencies, IT vendors, professional consultants, and claims adjusters. We make these disclosures to provide marketing, communicate with you, receive IT services and protect and secure your information, support credit, insurance, and claims reporting, receive guidance on tax, accounting, legal, and similar functions, and otherwise support our operations.

To nonaffiliated third parties to market to you, such as other insurance carriers, home services providers, and home damage restoration companies. You have a right to opt out of these disclosures.

To governmental and law enforcement entities, such as an insurance regulatory authority, state and federal investigators, or courts of law. These disclosures are typically as result of a regulatory or licensure requirement, to prevent or prosecute fraud, to protect our interests, if we reasonably believe illegal activities have been conducted, or if we are required by a binding court order or subpoena.

To our affiliates, as permitted by law. For example, we may disclose your information to an affiliate to provide marketing or in connection with an audit. We may also share this information with our affiliates to coordinate the insurance and smart home services provided to you so that those services can be smarter and more useful to you. When we disclose information about your creditworthiness, or disclose information for our affiliates to market to you, you have a right to opt out of these disclosures as explained in more detail below.

To a third party in connection with a sale of our business or assets or reorganization proceeding, including a bankruptcy or liquidation. For example, we may disclose your information as part of negotiations or due diligence for a corporate transaction.

How We Protect Your Information

We use a variety of administrative, technical, and physical controls to help protect your information, including restricting access to the personnel to have a legitimate need for the information.

Your Rights

If you are a resident of Arizona, California, Connecticut, Georgia, Illinois, Maine, Massachusetts, Minnesota, Montana, Nevada, New Jersey, North Carolina, Ohio, Oregon, or Virginia, you may request access to, correction of, and/or deletion of your information.

If you request access to your information, we will describe the nature and substance of the information we have about you, with whom we have shared it, and the procedures for requesting correction or deletion. You may also view a copy of your information in person or ask for a copy by mail, for which we may charge a reasonable fee to cover our costs.

If you request correction to or deletion of your information, we will either correct or delete the information in dispute or notify you of our refusal, the reasons for our refusal, and your right to file a statement of your disagreement with our refusal. For residents of states not listed above, we will take reasonable steps to confirm the accuracy of your information upon your request.

Your rights to access, correct, and delete do not apply to information that is collected in connection with or anticipation of a claim or civil or criminal proceeding.
