Electronic Signature & Disclosure Consent

Vivint LLC and NRG Energy Inc. and each of their corporate affiliates (collectively, “we” or “us”) are legally required to give you specific information about our communications with you “in writing,” which means on paper unless you agree otherwise.  We need your consent to provide this information to you electronically instead.  

Consent. By agreeing to this consent, you consent: (1) to receive all Documents related to this Transaction electronically instead of on paper, and (2) to sign this agreement electronically, such as by drawing your signature or initials, checking a box, or clicking a button. You give this consent on behalf of yourself and any other person who uses the telephone number(s) you provide to us. The term “Documents” means all disclosures and other information we are legally required to provide to you in writing for this Transaction. The term “Transaction” means your agreement that we (or a third party acting on our behalf) may deliver marketing-related calls and text messages to the telephone number(s) you provide, including by using an automatic telephone dialing system or prerecorded voice messaging.

Duration of your consent and how to withdraw. Your consent will automatically expire once we have provided you with all required Documents related to this Transaction. If you wish to withdraw this consent before we have provided the Documents to you, please call (855) 898-8908 and specify that you are withdrawing your consent to electronic delivery of the Documents. You can also call (855) 898-8908 and specify that you are revoking your consent to receive marketing-related calls and text messages to the telephone number(s) you’ve provided.  

Your alternatives. You are not required to provide this consent. If you would prefer to receive the Documents on paper instead, or if you give this consent but would also like a paper copy of the Documents, please call (855) 898-8908. You will be charged $1 for each paper copy we mail to you at your request. 

How we will electronically provide you with Documents. We will provide the Documents to you electronically by making them viewable to you online or by sending them to you by email, text message, or another electronic method. We recommend that you either save the Documents electronically or print paper copies for your records. By agreeing to this consent, you acknowledge that you have the ability to access, view, download, save, and print any Documents we provide to you electronically.

Hardware and software requirements. By agreeing to this consent, you acknowledge that you have access to and understand how to use a computer with a supporting operating system, internet access, an internet browser, and PDF reading software, and that you have access to and understand how to use an email account and a printer.

Data security. You acknowledge that the internet is not a secure network and that electronic communications transmitted over the Internet may be subject to unauthorized access by unintended third parties. Although we have implemented reasonable technical safeguards to protect our communication systems from unauthorized access, we cannot guarantee perfect network security. Consequently, you accept that receiving or sending communications via the internet is done at your own risk.
